Free Case Consultation Hablamos Español There are several different steps in the appeals process: Informal hearings This is designed to be an expedited method of addressing your appeal. After submitting a “Claim Petitition” to the Division of Workers’ Compensation, your case will be assigned to a Judge. Workers’ Compensation cases often require the intervention of the Judge to often his/her opinion on the value of your case. A Judge will make a recommendation to settle the dispute, but it is not binding. Formal hearings In the event a dispute cannot be resolved by consent of the parties, formal litigation may be required. Both sides present evidence and question witnesses. After both sides have presented their case, the judge will issue a written decision. State courts If the judge in a formal hearing rules against you, the appeals process moves from the Division of Workers’ Compensation to the state courts of New Jersey in the Appellate.
